SEC. 164 OF Cr.P.C. confession or statement
SEC. 164 statement recorded by magistrate under sec. 164 of cr.p.c. the essential condition is that it must be made voluntarily and not under thereat or coercion and the confessional statement must be corroborated with the facts of the case - then only the court can considered it as a peace of evidence against the accused and against the person who made confession.Recording of confessions and statements -[1] any metropolitan magistrate or a judicial magistrate may, whether or not he has jurisdiction in the cause, record any confession or statement made to him in the course of an investigation, at any time before the commencement of the inquiry trail. etc.,- 2010 SAR criminal 712.
