unnecessarily returning the plaint without raising all the relevant objections at a time. - A consideration of these objections raised by the office of the trial Court clearly reflected that they are quite unnecessary at this stage. They are also giving an impression that the office is taking such objections which possibly the defendants would raise in the written statement. This course is impermissible. AP HIGH COURT ; AMARAVATHI;

THE HON’BLE SRI JUSTICE M.VENKATA RAMANA

C.R.P.No.1457 OF 2021

ORDER:-

Bommareddy Subba Reddy,
Versus

Bommareddy Satyavathi,

Heard Sri Sai Gangadhar Chamarty, learned counsel for the

petitioner.

The complaint of the petitioner is that the trial Court is

unnecessarily returning the plaint without raising all the relevant

objections at a time.

Learned counsel for the petitioner also pointed out certain

objections raised on 15.12.2021.

A consideration of these objections raised by the office of the

trial Court clearly reflected that they are quite unnecessary at this

stage. They are also giving an impression that the office is taking

such objections which possibly the defendants would raise in the

written statement. This course is impermissible. There is

justification in the complaint of the petitioner.

In the above circumstances, this Civil Revision Petition is

allowed directing the Court of the learned XI Additional District

Judge, at Gudiwada to register the suit, if otherwise in the order

within 48 hours of the receipt of copy of this order. If any

objections are not complied, the superintendent of the concerned

Court shall call learned counsel appearing for the petitioner in the

trial Court and get necessary rectifications carried out or to supply

such omissions pointed out. No costs.

Miscellaneous applications pending, if any, in this case

stand closed. Interim orders granted if any, stand vacated.
