Arbitration & conciliation Act - Main agreement contains Arbitration clause between main parties - Internal agreements between the parties to main agreement among them respectively with third parties though not contained arbitration clause and when those are subject to main agreement - No civil court hold jurisdiction to resolve the dispute between the parties in respect of main subject - only remedy is through the arbitration only High court and DB wrongly hold as novation of contract and wrongly nullified the arbitration clause - When arbitration clause is valid one - the parties have no remedy in civil court only before arbitration = CHATTERJEE PETROCHEM CO. & ANR ………APPELLANTS Vs.
